ΔΕΛΤΙΟ ΤΥΠΟΥ

Η Επιτροπή Επαγγελματικού Αθλητισμού, κατά τη σημερινή της συνεδρίαση, χορήγησε πιστοποιητικό συμμετοχής στο πρωτάθλημα Α1 Μπάσκετ στην ΚΑΕ ΑΕΚ, μέχρι λήξεως της ισχύος της προσωρινής διαταγής , που εκδόθηκε από το πτωχευτικό δικαστήριο , περί αναστολής των ατομικών διώξεων των πιστωτών.
Κατόπιν αυτού ολοκληρώθηκε η χορήγηση πιστοποιητικών συμμετοχής σε όλες τις ομάδες που θα συμμετέχουν στο πρωτάθλημα Α1 κατηγορίας Μπάσκετ.

Επίσης κατά τον έλεγχο των φακέλων των ΤΑΠ, που έχουν δικαίωμα συμμετοχής στα πρωταθλήματα Α1 και Α2 κατηγορίας , χορηγήθηκαν πιστοποιητικά στις ομάδες: ΠΑΟΚ, Άρη, Κηφισιά, Φοίνικα Σύρου, Απόλλων Καλαμαριάς και ΑΕΚ.

Μπορεί να περάσαμε έστω και στο και πέντε το θέμα με το πιστοποιητικό συμμετοχής στο πρωτάθλημα και να σιγουρέψαμε το γεγονός πως θα παίξουμε την επόμενη βδομάδα με τον ΠΑΟΚ για το Κύπελλο, αλλά τώρα υπάρχει το ζήτημα με τι ομάδα θα πάμε στην Πυλαία...
Γιατί εξακολουθεί να παραμένει σε ισχύ η απαγόρευση διεθνών μεταγραφών από τη FIBA λόγω των οφειλών σε Pavic & τους παίκτες του Δημητρόπουλου.
Από τους παίκτες που έχουμε σίγουρα μπορούν να παίξουν οι Δορκοφίκης, Αντωνάκης, Σταμάτης, Μαρίνος, Νικολαϊδης, Καλλινικίδης, McGrath, Τουντζιαράκης.
Υπάρχει η αντιγνωμία για το αν "διεθνής μεταγραφή" είναι από χώρα σε χώρα, ή μόνο από πχ Fiba-America σε Fiba-Europe. Δηλαδή σίγουρα δεν παίζουν αυτή τη στιγμή οι Mack, Mels ενώ αμφίβολο είναι τι παίζεται με Francis, Green, Stefanov .

Σύμφωνα με τα ΜΜΕ υπάρχει deadline μέχρι τη Δευτέρα 5/10, να κλείσουμε το θέμα..

Μια που δεν έχει πάρει το μάτι μου καμιά αναφορά πουθενά για τις αποφάσεις και τα σχετικά..

FIBA Arbitral Tribunal (FAT)

FIBA introduces a new service for the resolution of disputes between players, agents and clubs through arbitration. Please find below the main features of the FIBA Arbitral Tribunal:

• True Arbitration under Swiss Law (seat of each arbitration is Geneva),
• Single Arbitrator appointed by the FAT President,
• Simple procedure,
• English language only,
• Hearing and hearing of witnesses upon application only,
• Provisional and conservatory measures available,
• Arbitrator decides ex-aequo et bono, i.e. on the basis of general considerations of justice and fairness without reference to any particular national or international law,
• Decision within six weeks of end of proceedings,
• Appeal to Court of Arbitration for Sport (CAS).

Failure to honor a FAT Award may entail sanctions by FIBA such as, as the case may be, a monetary fine, the withdrawal of a FIBA Agent's License, a ban on international transfers of players or a ban on registration of new players, as provided in the FIBA Internal Regulations.

Έχουμε δυο καταδίκες εις βάρος μας.

04/12/2008FAT 0005/08 (Pavic v/ AEK BC)

In view of the fact that AEK BC continues to be in breach of its obligation to honour the FAT award, FIBA imposed a ban on registration of new players on AEK BC.

In accordance with Article L.2.7.1 of the FIBA Internal Regulations, FIBA sanctioned AEK BC with a monetary fine of EUR 15,000 for failing to honour the FAT award.

The Slovenian player Smiljan Pavic filed a claim against the Greek Club AEK BC for late salary payments and damages in connection with an employment contract. AEK BC filed a petition to stay the proceedings because of the case already pending in Greece. The arbitrator decided that the conditions set by Swiss Law to stay the proceedings were not met in the present case and that the non payment of the player's salaries by AEK BC constituted a grave breach of its obligations which justified early termination of the contract by the player.

30/03/2009FAT 0020/08 (Dimitropoulos v/ AEK BC)

In view of the fact that AEK BC continues to be in breach of its obligation to honour the FAT award, FIBA imposed a ban on registration of new players on AEK BC.

In accordance with Article L.2.7.1 of the FIBA Internal Regulations, FIBA sanctioned AEK BC with a monetary fine of EUR 15,000 for failing to honour the FAT award.

The players' agent Georgios Dimitropoulos filed a claim against the Greek club AEK BC for outstanding payments. The parties had signed an agreement whereby the club acknowledged its debts towards the agent and four basketball players and agreed to pay the outstanding amounts in two instalments.

Subsequentely, the club failed to comply with its obligations as provided in the agreement. Despite several invitations by the FAT, AEK BC did not make any submissions.

Nevertheless, the Arbitrator proceeded with the arbitration and ordered the club to pay the requested amounts to the agent.
